Register Your Trademark Globally From Brazil

The Brazilian Patent and Trademark Office has been accepting both national and international trademark applications since October 2019. The reason? It’s because Brazil became a member of the Madrid System by signing the Madrid Protocol.

The Madrid System allows Brazilian individuals and companies to file applications domestically using a single form. Brazil then processes local applications while forwarding to the World Intellectual Property Organization applications addressed to other member countries.

In the past, applicants had to file their Brazilian applications in Brazil and also reach out to the trademark offices in other countries where they wanted to file. But now, it’s more straightforward. And better yet, everything can be paid in a single currency. Plus applicants can choose the language they prefer for the procedure.

So far, the Madrid System has 108 members representing more than 120 countries. In addition to Brazil, the list of member countries includes China, India, and the United States.

Having a local agent assist in the filing process isn’t required. In fact, the entire process can be done online. However, it’s definitely recommended. And if the application is denied or there’s a dispute, you’ll want an IP lawyer who can defend your rights.
